Terms and Conditions Acceptance

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site. We may at any time revise these terms and conditions without notice. It is up to you to ensure you regularly review and reprint them for your records as necessary.

Checking Products on Receipt

At Caribu we pride ourselves on the high quality of our products and the QA processes we have in place.

We ask that you check your rugs & products carefully, before using on your horse or making any modifications, to satisfy yourself that they are of high quality and free from any manufacturing defects, which may shorten the expected life of your purchase. This ensures that if a rug or product is damaged sooner than expected you can be satisfied  the product was sound to begin with and any damage is a result from an accident. It can be hard to discern if there was a manufacturing fault with a rug after your horse has destroyed it.

We also ask you to consider if the items purchased will suit the nature and temperament of your horse and the environment you plan on using our products. If you have any doubt about the quality or the suitability of the products you have purchased to match the horse and environment you plan on using them in, contact us immediately to arrange a return.

It is your responsibility to ensure you are satisfied with the quality and fitness of purpose for the products. When you fit the rug or product for the first time, we suggest try on over a sheet or another rug to check the fit and design, if you have any doubt about the fit, sizing, quality or its suitability for the task you have intended - please contact us to arrange an exchange or return the item. Remove the item from your horse immediately before it gets dirty. Items that are returned for exchange or refund that are dirty may not be excepted, or may be subject to a restocking fee to cover the costs of discounting your returned item that is dirty. If you are unsure of the fitting of a horse rug or how to use a particular item - please contact us for clarification before using the product. We are only to happy to assist.

Horses Safety

Horses are unpredictable animals and there is always a small possibility of a horse dislodging rugs, hoods, fly masks etc from scratching, snagging or other mischief and then panicking if their movement or vision is effected. When using rugs or hoods or masks on your horse you need to consider the horses temperament, location to other horses, environment and their overall suitability for wearing these types of products. We recommend only using masks, hoods or other items that may interfere with a horses vision in safe environments where the horse can be supervised at all times.

It is your responsibility to ensure purchased products are fit for the intended use. Caribu Horse Wear accepts no liability for loss, damage, injury or death or consequential loss to any property, person or animal resulting from the use or misuse, incorrect fitting or failure of any of our products. You hereby indemnity's and agrees to keep fully and effectually indemnified Caribu Horse Wear, its officers, directors, employees, agents, licensees and suppliers from and against all losses expenses damages and costs including legal fees on an indemnity basis resulting from any product purchased from Caribu Horse Wear. It is agreed that in consideration for the supply of the product to you, the liability Caribu Horse Wear for any claim, by or on behalf of you the Buyer, their Executors, Administrators and Assigns whether in contract, tort (including negligence) or otherwise for any loss or damage, including consequential loss arising out of or in connection with, or resulting from the manufacture, sale, delivery, resale, replacement or use of the product is hereby excluded to the fullest extent permissible by law whether such loss is caused by or contributed to by negligence or wilful act of Caribu Horse Wear

In no event shall Caribu Horse Wear be liable for any loss of profits, or special or consequential damages suffered by you, including interest charges.

Defective Items:

If an item has a demonstrable manufacturing defect we will happily replace the item. Check your rugs carefully to ensure you are 100% satisfied with the quality and fitness of purpose for the products you have purchased before using or modifying them. If your horse wears a rug and then damages it via misadventure - this is not considered defective. We don't guarantee that our rugs will last any set period of time - they can just as easily be destroyed in the first hour as they can 18 months later. However we go to great lengths to ensure rugs we supply are of high quality, with strong fabrics and fittings.

Horse Rug Warranty:

None of our products are sold with Express Warranties or Extended Manufacturers warranties. We do not guarantee that our rugs will last any set period of time, horses are unpredictable - horse rugs can just as easily be destroyed via misadventure in the first hour of use as they can 18 months later.

However, all our products are sold with a consumer guarantee. The law automatically gives consumers rights when they buy goods and services from a Qld business. These are called consumer guarantees. There are 9 consumer guarantees that apply to any goods purchased from businesses in Queensland. (Visit Qld Office of Fair Trading here) .

You are guaranteed that the goods you buy:

1) Are of acceptable quality (hence we ask you to check your products very carefully before using) This means goods must :-

    • be fit for its usual purposes
    • look acceptable in appearance and finish
    • have no defects
    • be safe
    • be durable for the task

This acceptable quality test considers:

    • the nature of the goods
    • the price paid for the goods
    • any claims the manufacturers make on the packaging or labels

This guarantee does not apply if:

      • you use the goods in an abnormal way.
      • goods are sold privately or at auction
      • Consumer was advised of any hidden defects before the sale
      • the defect should have been obvious when the consumer first saw the goods (unless they didn't’t see them at all before they bought them)

2) Match the description, sample or demonstration model you were shown (we show you detailed images)
3) Fit for a specific purpose. (as per our terms and conditions - we ask you to decide on receipt of your purchase if it is suitable for your horses temperament and the environment you wish to use in, and return for a refund if you have any doubt.)
4) Products have clear title, unless otherwise stated
5) Do not have any undisclosed securities (money owing on them)
6) Come with a right to undisturbed possession
7)
will have spare parts available for a reasonable amount of time after you buy them
8) will have express warranties honored if goods are advertised with Express or extended warranties

We go to great lengths to ensure we supply rugs that are of high quality, with strong fabrics and fittings to ensure they have the best chances of standing up to the stresses and pressures that horses can apply to them. With horses and rugs its only a matter of time before a horse rug gets damaged.

Common sense has to prevail, horses are large animals and damage to a horse rug can and will occur from an endless list of activities. Horses can and will, get themselves and their rugs, into all sorts of predicaments. When a 400kg of horse versus a 3kg rug - chances are the rug will come off second best! We will not honor replacements for any item that has been destroyed from misadventure. Rugs will get damaged and torn from slipping, snagging, biting, fencing, rolling, ill fitting rug etc - the list of possibilities is endless. The most common accidents occur from horses rolling then getting up and standing on the horse rug, belly surcingles or even leg straps because the rug has slipped in the process.

You also need to consider your horses temperament and environment you will be keeping him in to ensure the rug you have purchased will be suitable for him. Some horses are easy on rugs, others are rug wreckers. Rugs like polar fleece, wool or flag horse rugs are designed from fabrics that are functional in nature, but invariably weaker and easily susceptible to damage compared to better performing rugs like Canvas, Polycotton Ripstop or Mesh.

Pricing and availability.

The total price of your goods will be stipulated at the time you place your order. All prices are in Australian Dollars. We have the right to make alterations to the prices in the following circumstances:

- On extremely rare occasions, the cost of the product may have increased but not updated on the web site, taxes may have not been included in the price, or they may have changed. We will inform you immediately and before dispatch if this is the case to ensure you still wish to purchase, but at the revised cost.

- We reserve the right to refuse or cancel an order for goods if it has been listed or charged at an incorrect price due to a typographical error, input error or if there is a price alteration from our suppliers, or tax was calulated incorrectly when our price was published. If you have already been charged we will immediately refund you the total amount you have paid (including any delivery charges).

All products and services offered for sale on this web site are subject to availability and may be withdrawn at any time. Pictures used are for illustration only and although we endeavor to be as accurate as possible, may differ slightly from the actual product supplied. If goods cannot be supplied for any reason we will contact you and you will not be charged for the items ordered. If payment has already been taken, you will be refunded for the cost (and any postage charges if applicable) immediately.

We endeavour to hold stocks of all our active products, but if we are out of stock of your chosen item we will inform you of an estimated delivery date (subject to availability).

We cannot be held responsible for compensating you for any other losses you may suffer if we do not supply the goods.

Gift Certificates

Purchased Gift Certificates are valid for a period of 12 months from date of purchase. Please insure you use your certificate within 12months of purchase.
